Conditions of participation for the Weinfreunde competition

§ 1 Organizer

(1) The organizer of the competition is Wundermix GmbH, Dirnismaning 34D, 85748 Garching near Munich, represented by the managing directors Andreas Schreiner and Stephanie Schreiner and REWE Wein online GmbH, Schanzenstr. 6-20, Kupferwerk 2.20, 51063 Cologne, represented by the managing directors Clemens Uwe Bauer, Axel Bolten, Andreas Brensing and Cédric Garraud (hereinafter referred to as the organizer).

(2) This competition has no connection with Facebook or Instagram or any other social media provider on which this competition may be announced. The competitions are not sponsored, supported or organized by them in any way. The organizers are responsible for all aspects of the competition.

§ 2 Competition

The organizers are holding a competition. For this purpose, they have provided one or more prizes and will award these to the winner(s) in accordance with the following conditions.

§ 3 Eligibility to participate

(1) Only natural persons who are at least 18 years old and resident in Germany are eligible to participate. Employees of the organizers and/or affiliated companies as well as their relatives and life partners are excluded from participation.

(2) Participation in the competition is free of charge.

(3) Multiple participation, for example under a pseudonym or other email addresses, is not permitted and will result in exclusion from the competition.

§ 4 Conduct of the competition and prize

(1) The participant takes part in the competition by fulfilling the conditions of participation, which can be found in the publication of the specific competition (e.g. fulfilling certain tasks).

(2) The participation period begins and ends according to the competition post on the social media presence, i.e. according to the times specified there.

(3) The conditions for participation must be met during the participation period of the competition and submitted to the organizers in the manner offered. Participation in any other way than that offered for participation is excluded and will not be considered. Applications submitted before or after the competition will not be considered.

(4) The respective prize and the number of possible winners can be found in the publication of the specific competition.

(5) The winners will be determined by random drawing among all participants.

(6) Any disadvantages resulting from failure to send or sending incorrect contact details or failure to redeem the prize shall be borne by the participants.

§ 5 Notification of winners and delivery of the prize

(1) The winners will be informed after the end of the participation period via a direct message on the respective platform on which the competition is being held (e.g. Instagram or Facebook). By participating in the competition, the participant agrees to be contacted in the event of a win. Contact will be made solely for the purpose of processing the prize.

(2) The winner must confirm receipt of the prize notification within 14 days and provide their full contact address (name, address, postcode, city, email address) for processing the prize delivery. If the direct message cannot be delivered or the winner does not respond within 14 days, the prize will be forfeited and a new winner will be chosen.

(3) Cash payment of the prize is excluded.

(4) The claim to the prize cannot be assigned, i.e. cannot be transferred to third parties.

(5) Depending on the type and amount of the prize, the prize will be sent either by post or parcel within Germany.

§ 6 Early termination of the competition

The organizers reserve the right to terminate the competition at any time without prior notice and without stating reasons for good cause. Termination for good cause can occur in particular if the proper conduct of the competition can no longer be guaranteed for technical or legal reasons.

§ 7 Content shared by the participant

(1) Contributions (in words, images, moving images or other forms) by participants in connection with this competition must not violate legal provisions, e.g. criminal law provisions. No offensive, defamatory, unauthorized, malicious, personal rights-violating, violent or racist content may be published in connection with this competition.

(2) The participant undertakes not to infringe any copyright, patent or trademark rights or other protective rights of third parties. The participant assures that he can freely use his contributions for the intended purposes of the competition and that the rights of third parties such as name rights, trademark rights (brands, designs), copyrights or personal rights do not conflict with them; the participant indemnifies the organizers against any corresponding claims of third parties.

(3) The organizers reserve the right to delete individual contributions from participants if they violate any of the aforementioned provisions or if, in their reasonable opinion, the content is illegal or violates common decency for any other reason.

§ 8 Limitation of Liability

The organizers are only liable for damages that arise to the participant due to grossly negligent or intentional behavior on the part of the organizers or a vicarious agent of the organizers or due to the violation of essential contractual obligations (i.e. obligations whose fulfillment makes the proper conduct of the competition possible in the first place and on whose compliance the participant can regularly rely). The above limitation of liability does not apply to damages resulting from injury to the life, body and/or health of the participant.

§ 9 Exclusion from participation

In the event of a breach of these conditions of participation, the organisers expressly reserve the right to exclude the participant in question from participation.

§ 10 Data protection

(1) By confirming and submitting his data, the participant agrees that the data he has submitted will be collected, processed and used within the scope of the competition.

(2) The organizers collect and use the participants' data only to the extent permitted by law or with the participants' consent. All data communicated to the organizers will be processed in accordance with the legal provisions, in particular the GDPR.

(3) Personal data will only be collected, processed and used by the organizers for the purpose of designing, carrying out and processing the competition. This includes in particular the general information of the participant on the social media platforms (e.g. Facebook or Instagram) as well as the contact details of the winner, such as their name, email address and the address for processing the prize.

§ 11 Applicable law

The organizer’s competition is subject exclusively to the laws of the Federal Republic of Germany.

§ 12 Severability Clause

Should any provision of the Conditions of Participation be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions of the Conditions of Participation.
