Conditions of participation in the competition

§ 1 Organizer
(1) The organizer of the competition is Wundermix GmbH, Dirnismaning 34D, 85748 Garching near Munich (hereinafter referred to as the organizer) represented by the managing directors Andreas Schreiner and Stephanie Schreiner.
(2) This competition has no connection with Facebook or Instagram or any other social media provider on which this competition may be announced. The competitions are in no way sponsored, supported or organized by them. The organizer is responsible for all matters relating to the competition.
§ 2 Competition
The organizer is organizing a competition. For this purpose, it has provided one or more prizes and will award them to the winner or winners in accordance with the following conditions.
§ 3 Eligibility to participate
(1) Only natural persons who have reached the age of 18 and are resident in Germany are eligible to participate. Employees of the organizer and/or affiliated companies as well as their relatives and life partners are excluded from participation.
(2) Participation in the competition is free of charge.
(3) Multiple participation, for example under a pseudonym or additional email addresses, is excluded and will result in exclusion from the competition.
§ 4 Implementation of the competition and winnings
(1) The participant takes part in the competition by fulfilling the conditions of participation, which can be found in the publication of the specific competition (e.g. fulfillment of certain tasks).
(2) The participation period begins and ends according to the competition post on the social media presence, i.e. according to the times stated there.
(3) The requirements for participation must be met during the participation period in the competition and must be submitted to the organizer in the manner provided. Participation by any means other than that offered for participation is excluded and will not be taken into account. Applications for participation submitted before or after will not be considered.
(4) The respective prize and the number of possible winners can be found in the publication of the specific competition.
(5) The winners will be determined using a random draw among all participants.
(6) Any disadvantages resulting from non-mailing or sending incorrect contact details or from not redeeming the prize will be borne by the participants.
§ 5 Notification of the winners and transmission of the prize
(1) The winners will be informed after the end of the participation period via a direct message on the respective platform on which the competition is held (e.g. Instagram or Facebook). By taking part in the competition, the participant agrees to be contacted if they win.
Contact is made solely for the purpose of processing the winnings.
(2) The winner must confirm receipt of the prize notification within 14 days and provide their full contact address (name, address, zip code, city, email address) to process the dispatch of the prize. If delivery of the direct message is not possible or if the winner does not respond within 14 days, the prize will be forfeited and a new winner will be chosen.
(3) A cash payment of the prize is excluded.
(4) The claim to the prize cannot be assigned, i.e. cannot be transferred to third parties.
(5) Depending on the type and extent of the prize, the prize will be sent either by post or parcel within Germany.
§ 6 Early termination of the competition
The organizer reserves the right to end the competition at any time without prior notice and without giving reasons for good cause. Termination for good cause can occur in particular if proper implementation of the competition can no longer be guaranteed for technical or legal reasons.
§ 7 Content shared by the participant
(1) Contributions (in words, pictures, moving images or other forms) by the participant in connection with this competition must not violate legal provisions, e.g. criminal law provisions. No hurtful, defamatory, unauthorized, malicious, personal rights, violence-glorifying or racist content may be published in connection with this competition.
(2) The participant undertakes not to violate any copyright, patent or trademark rights or other proprietary rights of third parties. The participant assures that he can freely dispose of his contributions for the intended purposes of the competition and that this does not conflict with the rights of third parties such as name rights, trademark rights (brands, designs), copyrights or personal rights; The participant holds the organizer harmless from corresponding claims from third parties.
(3) The organizer reserves the right to delete individual contributions from participants if they violate one of the aforementioned provisions or if, in its reasonable opinion, the content is illegal for another reason or violates common decency.
§ 8 Limitation of liability
The organizer is only liable for damages caused to the participant by grossly negligent or intentional behavior on the part of the organizer or one of the organizer's vicarious agents or by the violation of essential contractual obligations (i.e. those obligations whose fulfillment makes the proper implementation of the competition possible in the first place and on their compliance). the participant can regularly trust). The above limitation of liability does not apply to damage caused by injury to the life, body and/or health of the participant.
§ 9 Exclusion from participation
In the event of a violation of these terms and conditions of participation, the organizer expressly reserves the right to exclude the participant in question from participation.
§ 10 Data protection
(1) By confirming and submitting his data, the participant agrees that the data he has submitted will be collected, processed and used as part of the competition.
(2) The organizer collects and uses the participants’ data only to the extent permitted by law or to the extent that the participants consent. All data provided to the organizer will be processed in accordance with legal regulations, in particular the GDPR.
(3) Personal data will only be collected, processed and used by the organizer for the design, implementation and handling of the competition. This includes in particular the participant's general information on the social media platforms (e.g. Facebook or Instagram) as well as the winner's contact details, such as in particular their name, email address and the address for processing the prize.
(4) For information on the handling of personal data and other information, we refer to our data protection declaration .
§ 11 Applicable law
The organizer's competition is subject exclusively to the law of the Federal Republic of Germany.
§ 12 Severability clause
Should a provision of the terms and conditions of participation be or become wholly or partially ineffective, this will not affect the validity of the rest of the terms and conditions of participation.
