Conditions of participation

§ 1 Organizer
(1) The organizer of the competition is Wundermix GmbH, Dirnismaning 34D, 85748 Garching near Munich (hereinafter referred to as the organizer) represented by the managing directors Andreas Schreiner and Stephanie Schreiner.
(2) This competition is in no way connected to Facebook or Instagram or any other social media provider on which this competition may be announced. The competitions are in no way sponsored, supported or organized by them. The organizer is responsible for all aspects of the competition.
§ 2 Competition
The organizer is organizing a competition. For this purpose, it has provided one or more prizes and will award these to the winner(s) in accordance with the following conditions.
§ 3 Eligibility to participate
(1) Only natural persons who have reached the age of 18 and are resident in Germany are eligible to participate. Employees of the organizer and/or affiliated companies as well as their relatives and life partners are excluded from participation.
(2) Participation in the competition is free of charge.
(3) Multiple entries under pseudonyms or other e-mail addresses are not permitted and will result in exclusion from the competition.
§ 4 Implementation of the competition and prize
(1) The participant takes part in the competition by fulfilling the conditions of participation, which can be found in the publication of the specific competition (e.g. fulfillment of certain tasks).
(2) The participation period begins and ends according to the competition post on the social media presence, i.e. according to the times specified there.
(3) The requirements for participation must be met during the participation period of the competition and submitted to the organizer in the manner offered. Participation by any other means than the one offered for participation is excluded and will not be considered. Applications for participation submitted before or after this time will not be considered.
(4) The respective prize and the number of possible winners can be found in the publication of the specific competition.
(5) The winners will be determined by means of a random draw among all participants.
(6) Any disadvantages resulting from the failure to send or the sending of incorrect contact details or the failure to redeem the prize shall be borne by the participants.
§ 5 Notification of the winners and transmission of the prize
(1) The winners will be informed after the end of the participation period via a direct message on the respective platform on which the competition is held (e.g. Instagram or Facebook). By participating in the competition, the participant agrees to be contacted in the event of winning.
Contact is made solely for the purpose of processing the prize.
(2) The winner must confirm receipt of the prize notification within 14 days and provide their full contact address (name, address, zip code, city, email address) for the purpose of processing the dispatch of the prize. If it is not possible to send the direct message or if the winner does not respond within 14 days, the prize will be forfeited and a new winner will be chosen.
(3) Cash payment of the prize is excluded.
(4) The claim to the prize cannot be assigned, i.e. cannot be transferred to third parties.
(5) Depending on the type and size of the prize, the prize will be sent either by post or parcel post within Germany.
§ 6 Premature termination of the competition
The organizer reserves the right to terminate the competition for good cause at any time without prior notice and without giving reasons. Termination for good cause may occur in particular if the proper execution of the competition can no longer be guaranteed for technical or legal reasons.
§ 7 Content shared by the participant
(1) Contributions (in word, image, moving image or other form) by the participant in connection with this competition may not violate legal provisions, e.g. criminal law. No offensive, defamatory, unauthorized, malicious, violating personal rights, glorifying violence or racist content may be published in connection with this competition.
(2) The participant undertakes not to infringe any copyrights, patent rights, trademark rights or other industrial property rights of third parties. The participant assures that he/she can freely dispose of his/her entries for the intended purposes of the competition and that the rights of third parties such as name rights, trademark rights (brands, designs), copyrights or personal rights do not conflict with this; the participant shall indemnify the organizer against any corresponding claims by third parties.
(3) The organizer reserves the right to delete individual entries from participants if they violate any of the aforementioned provisions or if, in its reasonable opinion, the content is unlawful for any other reason or offends common decency.
§ 8 Limitation of liability
The organizer shall only be liable for damages incurred by the participant as a result of grossly negligent or intentional conduct on the part of the organizer or one of the organizer's vicarious agents or as a result of a breach of material contractual obligations (i.e. obligations whose fulfilment is essential for the proper execution of the competition and on whose compliance the participant may regularly rely). The above limitation of liability does not apply to damages resulting from injury to life, limb and/or health of the participant.
§ 9 Exclusion from participation
In the event of a breach of these conditions of participation, the organizer expressly reserves the right to exclude the participant concerned from participation.
§ 10 Data protection
(1) By confirming and transmitting his/her data, the participant agrees that the data transmitted by him/her may be collected, processed and used in the context of the competition.
(2) The organizer collects and uses the participants' data only to the extent permitted by law or with the participants' consent. All data provided to the organizer will be processed in accordance with the statutory provisions, in particular the GDPR.
(3) Personal data will only be collected, processed and used by the organizer for the design, implementation and handling of the competition, including in particular the general information of the participant on the social media platforms (e.g. Facebook or Instagram) as well as the contact details of the winner, such as in particular his name, e-mail address and the address for the prize processing.

§ 11 Applicable law
The competition of the organizer is exclusively subject to the law of the Federal Republic of Germany.
§ 12 Severability clause
Should a provision of the conditions of participation be or become invalid in whole or in part, this shall not affect the validity of the remaining conditions of participation.
